If it were me, I would contact Apple as to what would be the best way in which to resolve this. After all, it was an OS update that caused the problem.

The problem for me is that if I understand it correctly if I turn off iCloud for some things that data has been moved to I can lose that data.

When upgrading my Mac I very cautiously check to make sure that any iCloud stuff is turned off in the early stage of the upgrade. iPhone doesn¡¯t give you the chance.
