Apologies for the late notice on this, but some of you may have been tracking traffic on a hearing tonight for permitting of the Capitol Power Plant.? The plant is seeking air quality approvals from the DC Department of the Environment.?

I spent some time talking to the regulator and others. ? Here is what I sent my constituents

Capitol Power Plant
?
There have been lots of emails flying around about the new?permit application from the Capitol Power Plant. I have spent some time with DC?permitting staff, the internet and some?former Hill staff to understand more?about what is going on.? ? ?First, the?power plant has been generating steam from coal and natural gas powered boilers?for some time.? ??The?amount of coal being?used in the last few years has dropped primarily because of warm winters (irony?alert) and because of the dropping natural gas prices.? ??The plant is now?applying to bring two new?boilers online that would produce both steam and electricity from natural gas?and potentially fuel oil.??These new?boilers are more efficient and less?polluting than the existing boilers and are?likely to be the core production units for the plant.??
?
As part of the process for adding generation capacity, the?plant is applying for permits that would set a plant wide limit on their?pollution.? ?That is part of a federal?rule that requires?new sources of generation to undergo stricter permitting to?reduce emissions.??The plant is currently?operating without plant-wide limits.??The?DC air office believes that these?plantwide limits will reduce emissions on a?range of pollutants below the traditional levels from the plan but not?necessarily below the last two years which are viewed as abnormally?low.?
?
The likelihood for the plant going forward under these?proposed permits is that they will burn less coal than they historically have,?but not the no coal that many believed was either?the case or their obligation.
?
The pollutants in question are serious business.??Pollutants that cause ground level ozone?pollution that trigger heart attacks and asthma, and soot pollution which?contributes to?respiratory diseases.???Needless to say they do not mix well with kids or seniors.? ?The district is in non-compliance for these?pollutants which is why they are regulated through the?district.
?
I have asked for more information from District on coal use?historically at this facility and am consulting with a few other experts, but I?would generally recommend that if people are?going to contact the District,?that you acknowledge that this is a step forward in reducing pollution, but?that we can still do better and can further reduce our reliance on coal which?is?the primary cause of toxic air pollution and global warming pollution.
?
A public hearing will be held at the District Department of?the Environment offices at 1200 First Street NE, Washington DC on December 17,?2012 at 5:30 PM. ?If you want to testify?at this hearing you must submit?in writing their names, addresses, telephone numbers, and affiliation, if any,?to Mr. Stephen Ours at DDOE by 4:00 p.m. on Monday, December 17,?2012.

Hi Larry,

My understanding is that this may be a little more nuanced than the CREDO petition might imply. ?

I am hearing that the coal is being laid in for back up purposes only, in the event that something happens with the natural gas system. ?I've seen some communications that posit that the plant is actually switching back to coal. ?What is your understanding of the situation?

Washington, DC's air,(1) the Capitol Power Plant was finally on track to
reduce its dirty coal pollution. But now, Architect of the Capitol
Building Stephen Ayers is trying to reverse that progress and even make
the problem much worse.

Ayers recently asked the city to roll back pollution limits for the
Capitol Power Plant so it can burn even more dirty coal than it already
does. The District Department of the Environment (DDOE) is accepting
public comments on Ayers' misguided plan to increase air pollution in DC,
but only until Monday.

Rather making Washington's air pollution problem worse by rolling back
pollution limits, DDOE should enact stricter limits that will help clear
the air and protect the health of those of us who live in the district.

Tell the District Department of the Environment: Strengthen pollution
limits for the Capitol Power Plant. Submit a public comment now.

Working to increase air pollution in the nation's capital takes a lot of
nerve, but Stephen Ayers went even further. Instead of waiting for his
disastrous proposal to be reviewed and decided on by DDOE, Ayers moved
forward with his plan in September by ordering 40 million pounds of dirty
coal for the plant.(2)

According to the American Lung Association, Washington, DC's air has
harmful levels of numerous pollutants, including Ozone, which causes
severe respiratory problems and can even lead to premature death.(3) Rolling
back air pollution limits is the last thing we should be doing.

The District Department of the Environment has the power to require the
Capitol Power Plant to reduce its air pollution, which will drastically
improve the air we breathe in Washington and save lives, but it won't do
so unless we build strong public pressure between now and Monday.

Please distribute this information to your members and constituents in the Capitol Hill Historic District (map attached).

The Historic Preservation Office is now accepting Part I applications for the Historic Homeowner Grant Program. The grants are available to low- and moderate-income households living in specific historic districts. Grants may be up to a maximum of $25,000, except the Anacostia Historic District where the maximum is $35,000.

The application deadline for the Part I application is December 21, 2012.

Grants will be awarded for exterior repairs, rehabilitation, and structural work on historic properties in the following historic districts: Anacostia, Blagden Alley/Naylor Court, Capitol Hill, Fourteenth Street, LeDroit Park, Mount Pleasant, Mount Vernon Square, Mount Vernon Triangle, Shaw, Strivers' Section, U Street, and Takoma Park. Work affecting sides of the house visible from public streets, which makes an appreciable difference in the appearance of the house, is encouraged.

The grant application is a two part process. In Part I, homeowners provide photographs of their house and a general description of the repairs and restorations they propose to make.

HPO reviews all Part I applications for eligibility. Eligible applicants will receive a Part II application and a detailed scope of work from HPO. To prepare the Part II application, applicants will use the scope of work to get price proposals from general contractors. Complete household financial information will also be submitted in Part II. Applications will be reviewed and selected by a committee appointed by the Director of the Office of Planning and the Chairman of the Historic Preservation Review Board.

Projects selected for grants will start construction in late spring 2013.

Hine Zoning Case Update, Hill East Development, Security and more zoning

Updates follow:

Zoning Commission Rules on Hine
Monday night, 19 November, the Zoning Commission voted 4-0 to approve the Hine Planned Unit Development (PUD), clearing the development to move forward. ?Barring any appeals, the developers, Stanton EastBanc, will likely close with the City in July 2013 and begin demolition in August 2013. ?There is much to do between now and then, including establishing a stakeholder group to coordinate construction activities, holding a logistics exercise to plan for continuity of market operations and securing the funds for Eastern Market Metro Plaza detailed in the ANC's Memorandum of Agreement with the Developer.

Hill East Development - Reservation 13 Hearing
The Deputy Mayor for Planning and Economic Development (DMPED) recently tendered Requests for Expressions of Interest for development of parcels G1 and F1 of the Hill East Waterfront Development (Reservation 13). ?"G1" and "F1" are two squares of land adjacent to the DC Armory Metro. ?ANC6B hosts a meeting with DMPED on Monday, November 26th to receive an update on the Request for Expressions of Interest and to field questions from the community. ?

Next Security Walk and Opportunities to Help MPD
If you need an opportunity to walk off some of the holiday calories, please join me for a security walk on November 30th from 9PM to 11PM. ?Rally at the corner of 13th and Independence. ?We'll be joined by MPD and will be encouraging neighbors to keep their front porches lit. ?

MPD is launching an effort to reduce holiday robberies, and will begin implementing modified tactics throughout the holiday season. ?As a part of this effort, MPD will distribute robbery and burglary tip prevention cards at Eastern Market metro. ?They would like residents to help with distribution--a great idea in my opinion. ?If you'd like to help, please let me know and I'll send dates and times as soon as I get them. ?

An Eastern Market Icon Passes
Ray Bowers, fromager of Bowers Fancy Dairy Products at Eastern Market, passed in his sleep on 15 November. ?Affectionately titled "The Cheese Man", Mr. Bowers provided a Seinfeld-esque dose of curmudgeonly affability to our community, and a liberal sampling of cheese to all of us erstwhile turophiles (cheese aficionados). ?He will be missed.

More Zoning?
On December 8, from 10AM to 12 noon at?1100 ?4th?Street SW, second floor,?the Office of Planning hosts a Ward 6 community meeting to review a proposed overhaul to the City's zoning code. ?The proposed revisions represent the most comprehensive overhaul of zoning regulations in 50-years, so it should be an interesting session.

Leaf Collection
The Department of Public Works (DPW) began leaf collection on?November 19 and will continue through December 1. ?A second round of collection will occur?between?December 17 and December 29.??

Leaves should be raked into the tree box area (between sidewalk and street) but?not in?the street by the day before the collections begin:?November 18 and December 16.? Twigs, branches, and other materials mixed up with the loose leaves can harm the vacuum system that picks up the leaves.

There are two regular Orange Hat weekly walking groups:

?The Mott¡¯s Orange Hats (7PM Tues at 12th & Gessford Ct SE) and the?Wednesday Orange Hats (830PM, Wed at 11th & South Carolina SE). ?I believe the leader of the Mott's Orange Hats monitors this list--so please correct me if I'm wrong.

?I also organize a walk approximately once a month. ?Times and days vary, but usually it's a late walk (9-11PM) on a Friday or Saturday, with MPD. ?I try to send out notice at least 7-days in advance.?

People can also attend the monthly PSA 107 meeting with Lt. Fowler. ?His meetings take place at Tyler Elementary on the 1st Thursday of each month at 7PM. ?These meetings provide a great opportunity to interact directly with MPD.

Folks,

I know this note is coming out on election day, and though late, it is not because I was undecided.? But while standing in line at the poll this morning, I had a moment to reflect on the years we have been living on the hill and I must say that since 1998 when we moved onto the Hill, I have never seen a more active ANC rep than Brian.? He is on top of neighborhood issues and works tirelessly to address them.? My personal interaction with Brian concerned a perennial theft from auto thief.? After our car window was smashed out the second time and my neighbors a third, I sent Brian an e-mail asking for advice on what to do.? The police said they knew exactly who was doing it and that they would bring the person in only to have him freed up a short time later.? Brian worked with the police and prosecutors office and spearheaded a Community Impact Statement campaign that helped hand the perpetrator the maximum sentence.? He also kicked off a series of late night neighborhood walks.

Brian has done many great things over the last two years and I support him for another term.

I have just read Commissioner Brian Pate's website explanation about Hine () and would recommend that everyone else voting take a bit of time to do so, too.

I would call your attention to the following passage from Brian's discussion:

"Some have also suggested that there would be no impact from ¡°walking away¡± from the negotiation, or voting against the development (essentially the same thing).? Maybe they are right¡ªand maybe the developer would have yielded on all of the above points with no further delays in replacing the dilapidated eyesore that currently occupies the Hine site.? Unfortunately, empirical evidence from throughout the City does not support that assertion.? The City closed and attempted to dispose of the Stevens School at 21st?and K St??NW at the same time they closed and began development discussions on the Hine property.? This site became mired in oppositional local politics, scuttling early deals.? The City only recently picked a new developer and the Stevens project is now almost 4-years behind the Hine project.? Other projects from across the City, such as the Skyland development in Wards 7&8 and the Tenleytown Metro Safeway project illustrate the potential delays incurred when neighborhoods and developers fail to work towards compromise."

I do, however, need to correct a few mistakes in your e-mail, and add just a little context here:

??1. ?Building Changes?- We influenced changes to the building through out the past 18-months of reviews and negotiations, not just through our MOA. ?The record of this is available on-line in our various ANC submissions to the Historic Preservation Review Board and Zoning Commission.

?2. ?Childcare Benefit?- The childcare facility is set at a?floor?of 24 children. ?Our agreement is structured to incentivize a larger facility.

?3. ?Hine Opposition?- You use "250" as the number of people in the SMD opposed to Hine. ?I'm not sure where that number comes from, but suffice it say that I represent 2200 residents and 1800 registered voters in the Single Member District. ?Opinions on this project varied more than you have suggested here.

?4. ?Flea Markets?- The independent operators of the Hine markets removed their opposition to the development after signing a letter of intent with Stanton EastBanc. ?The "death of the flea market meme" is a red herring and a straw man argument. ?I am confident that working as a community, we will implement a solution that actually expands the overall capacity of the Market.

Steve puts an emphasis on the Hine plan for two reasons:? because of its size and the fact that it is located in a primarily low-rise residential and commercial neighborhood, and because it is the most significant development in our neighborhood. ?It is also one of the most important issues our ANC has ever weighed in on.
??????????????? There never was a stark choice between putting some type of development on the Hine property or in leaving an empty building.? ?The issues have never been just about the size and density of the project, but with regard to the type of project and its impact on the neighboring community.? In fact, Steve wrote a letter to the Mayor supporting the original Stanton/Eastbanc proposal which was nearly as big as the current plan.? However, it included the Shakespeare Theater and several ?public interest organizations as tenants; adequate space for most of the flea markets; and a Charter School with its own school yard. ??Further, no one knew that the re-opened C Street was to become privatized and controlled by the developer with potentially negative impacts on the neighboring residents and businesses.? Nor that most of the affordable housing would be segregated in the lower quality North Building.
??????????????? As for the accuracy of Steve¡¯s statements, you be the judge.? Steve says the following:
I. ?That the ANC¡¯s decision to support Stanton/Eastbanc¡¯s project design at the Zoning Commission carried ¡°great weight¡±? and if the ANC had opposed Stanton/Eastbanc¡¯s plan and/ or insisted on specific improvements or remained neutral, the outcome might have been different and more positive for the neighborhood.? When the Zoning Commissioners announced the rationale for its preliminary approval of the project design in September, the dozens of witnesses who testified in opposition from our community and the nearly 200 letters it had received which opposed? the project were barely? mentioned.? ?However, the ANC¡¯s position was referred to 14 times which confirms the importance of the ANC¡¯s position to the Zoning Commission members in making its decision.
II. ?That the vote of our ANC Commissioner in support of the ANC memorandum was critical to the final outcome.? The ANC¡¯s vote to approve the agreement was 6-4.? Tie votes result in a rejection. ?Our Commissioner voted yes, but If he had voted ¡°no¡± the agreement would have failed and could have been improved to benefit the neighborhood.
III. That? more than 250? people in our single member district (SMD) who felt strongly enough to demonstrate their opposition to key elements of the project design through writing letters; by providing in-person testimony; by signing petitions; and putting up yard signs; represented a large enough voice to be given ¡°great weight¡± as how our elected representative would cast his vote.? Steve would have surely listened to what his constituents had to say and would have represented their interests.
IV. ?Finally, that the agreement made by the ANC was not in the community¡¯s best interest and that the benefits negotiated were insufficient compared to the scope and impact of the project.?
Additional details regarding the examples of community benefits and amenities which were cited last week are:
I.? Affordable housing: ?All of the housing in the project reserved for fixed income seniors and most of the affordable housing will be segregated in a separate, smaller and lesser quality building, which will be located across from C Street and separate from the main complex where all the market rate housing and will be built and where the project¡¯s amenities will be located. ??Many residents opposed this segregation of nearly all of the affordable housing, which is contrary to our city¡¯s current affordable housing policy
II.? Child Care Facility: ??The child care facility for ages 0-3years negotiated by the ANC has a capacity for only 24 children, which is too small since the spaces will probably be absorbed? by the Hine complex¡¯s residential and commercial tenants, resulting in no net gain for the neighborhood.
III.? The Community Meeting Space:? will be available for community meetings only if the developer controls a ground floor conference room and the space will only be able to be reserved ?a maximum of 7 days in advance, which will virtually eliminate its availability to community groups.?
IV.? The changes in the facade of the Hine development: ??Most of the changes to the building¡¯s design occurred before the ANC negotiated? its MOA with the developer. ?The only major change achieved by the MOA was taking away a very partial floor on 7th Street, SE, which the developer had previously insisted was already invisible from most lines of sight. ?This resulted in a net reduction in density of only 4,000 sq. ft. out of the 460,000 sq. ft. of the proposed project or less than 1%.
V.? The Flea Markets at Hine: ?The flea markets have been a part of the fabric of our neighborhood since the 1980s. ?What Steve has said is:?
??????????????? ?(i) ?During the anticipated 2-3 years of construction, the city may temporarily close the 300 block of 7th St, SE, during construction, but that has not yet been decided.? ?Even then, the closed street will only support about one- third (1/3) of the vendors now on Hine.

(ii) ?After construction, the flea markets on the Hine site will have less than one third of their current space reducing the total number of vendor tents in half. ?The narrow space on C Street, SE , will make it difficult, if not impossible, for furniture and other vendors with large or heavy goods to participate.? No possible additional usable space has been identified and vetted with the community.? Also, when the project is completed, the flea market vendors and the other Eastern Market vendors will only have 50 available parking spaces in the new parking garage, creating enormous pressure on the available neighborhood parking on weekends.

If, as expected, the project design is given final approval by the Zoning Commission in the next few months, Steve¡¯s position is clear and practical. ??We no longer have much leverage but there is a need to work pragmatically and creatively in order to positively influence the project as the developer¡¯s designs are refined and implemented so that the ANC will develop a win-win engagement with the developer for the benefit of our neighborhood.

Canal Park is opening, Nov 16!

Two weeks from today they will be cutting the ribbon and officially opening Canal Park .? Those buses we looked at for years are now a distant memory, and in their place we have a beautiful park that is remarkable not only for its beauty but also for its contribution to the environment with a neighborhood-scale storm water management system, geothermal heating and cooling systems, two electric car charging stations, and the largest rain garden in the District of Columbia.? The aesthetics are pretty impressive as well ¨C the ice skating path, water features, sculpture and interactive light cube.

Everyone is invited to join the ribbon cutting celebration in the park on Friday, November 16, from 10:45 a.m. until noon.? As you will see from the schedule below, there are a lot of family-friendly activities scheduled for Saturday that you may be interested in, as well.???

I just wanted to send around to our list my endorsement of Brian Pate for our ANC 6B05 commissioner. We have all been the beneficiaries of his dedication, hard work and enthusiasm for the job over the last 2 years. Not just by getting his very helpful regular community updates, but all the great work he has done to improve the safety of our area and move key projects forward like the bricking of the alley between 10th and 9th streets.

So, Brian is running for one final term as the ANC Commissioner for our Single Member District 05 (ANC6B05). You may be aware that he has a fairly aggressive opponent, Steve Holtzman, who appears to have a tendency to bend the truth. Brian has even asked to debate him twice and?Steve has refused.

Steve Holtzman's chief argument for his election revolves around the Hine development. In his literature, he?says that the ANC, and Brian, have failed to: a) achieve any meaningful changes in the development b) failed to secure any benefits for the Community in our Memorandum of Agreement with the developer and c) imperiled the future of the flea markets. It has been further amplified, in some places, that Brian has "sold out" the neighborhood and is actively working to evict the current Hine vendors. This is quite simply ALL false.

?

In addition, this election is not a one issue election. We care about lots of different issues that affect our community. So, please consider the full portfolio of Brian's work, from reforming ANC practices, to pursuing quality of life issues, to?focusing on our neighborhood security,?to working to improve our schools and to addressing vacant properties.

Also, from Brian here are some of the actual facts about Hine and Eastern Market:

A. Throughout the course of negotiations, Stanton Eastbanc made many changes to the development, some large, some small. Among the changes, they redesigned the facade of the 8th St building twice, increased the setback of the corner of the 8th & D St building, completely overhauled the facade of the 8th & D St building and removed a floor from the building at 7th and Penn.

B. In addition to the intrinsic benefits of the developments, such as affordable housing geared to seniors and retail opportunities, the MOA provides $125K in funds for improvements to the Eastern Market Metro Plaza; guaranteed parking for Eastern Market vendors; subsidized space for a 0-3 childcare facility; community meeting space; a flexible, programmable plaza; various protections for residents; one of the strongest construction management agreements in the City; and mechanisms to include stakeholders in deliberations about the project during and after construction.

C. Brian has worked hard to better the Market in many ways and has worked diligently to preserve the vending capacity of the Market throughout construction and beyond. For example, the developer has agreed to fund an exercise to test and optimize market logistics during and after construction. Brian also prepared and the ANC recently passed a resolution endorsing the closure of the 300 block of 7th St to support market operations during construction. And, while he is agnostic on the question of who should operate the market, he believes that the institution of Eastern Market must come first in all things. The Market is currently financially dysfunctional, to ignore this is to accept unnecessary risk. That means that the City should allocate revenues from any contracted market activity to the Eastern Market budget (not the General Fund), and that any contracting action should be transparent, open and fair.

Few think that the development is perfect, but there were three choices available: a) negotiate for the best deal possible and advance the development b) oppose the development, scuttle negotiations and relinquish our leverage or c) oppose the development and potentially delay the project indefinitely. Brian was not willing to cede our leverage, or accept a block sized dead space in our neighborhood for any longer than necessary and I fully support him in this pragmatic decision.
