WEEKLY-HALACHA FOR 5761

SELECTED HALACHOS RELATING TO PARSHAS SHELACH

By Rabbi Doniel Neustadt
Rav of Young Israel of Cleveland Heights

A discussion of Halachic topics.
For final rulings, consult your Rav.

HONOR and RESPECT FOR THE SEFER TORAH

A Sefer Torah, which is the living testimonial of God's covenant with the
Jewish people, must be treated with the highest degree of respect and
dignity. Accordingly, there are special halachos which are associated with
the removal and returning of the Sefer Torah when it is taken out of the
Aron ha-Kodesh for Kerias ha-Torah, the Reading of the Torah. The
following
is the proper procedure:

The chazan should not be the one to take the Torah out of the aron. To
accord the Torah due respect, another person is appointed to open the
aron,(1) take out the Torah and hand it to the chazan to carry to the
bimah.(2) If no one was appointed to the task, the chazan may "rush to
grab
this mitzvah for himself."(3)

The Torah is taken out of the aron with one's right hand although the left
hand may be used to help. A left-handed person may take out the Torah with
his left hand.(4) But the Torah is always handed, received and held with
one's right hand(5) even if its being given, received or held by a person
who is left-handed.(6)

At the time that the Torah is being taken out of the aron, it is
customary(7) to recite Berich Shmei,(8) which is a section of Zohar
written
in Aramaic.(9) Some recite Berich Shmei before the Torah is removed from
the
aron,(10) while others insist that Berich Shmei be said only after it has
been taken out.(11) One who neglected to recite Berich Shmei at the proper
time may recite it until the Torah is unrolled.(12)

When the chazan recites Shema and Echad he should face the congregation.
When he recites Gadlu, he turns to face the aron.(13) He should raise the
Torah slightly when reciting each of these verses.(14)

One is required to stand,(15) without leaning, anytime the Torah is "in
motion." [Many poskim attempt to give the benefit of the doubt to those
who
sit on Simchas Torah during the hakafos even though the Torah is in
motion.(16) Still, it is proper for a God-fearing person to stand during
the
hakafos unless he himself is holding a Torah.(17)] Thus when the Torah is
being carried from the aron or being raised for hagbahah, one is obligated
to stand until it is placed on the bimah or until it is no longer within
view.(18)

[When the Torah is not "in motion" the following rules apply(19): 1) If
the
Torah is in the aron and the aron is closed, if it is placed on the bimah
or
is being held by someone who is sitting down, there is no reason to stand.
2) If it is being held by someone who is standing up (e.g., during Keil
maleh rachamim), or it is standing upright in the aron and the door of the
aron is open, it has become standard practice to honor the Torah by
standing - even though one is not required to do so.(20) 3) If, while
being
carried, the person carrying the Torah stops to rest, one is required to
remain standing, as this is considered "in motion".]

As the Torah makes its way through the right-hand side of the shul towards
the bimah, it is considered proper for the congregants to honor it by
following behind(21) as it passes by them.(22) Others hold that it is
considered "haughty" to do so and it should not be done.(23) All agree
that
there is no point for those who are not in the path of the Torah (e.g.,
their seat is behind the bimah) to come to the front of the shul so that
they can follow the Torah.

It is customary and considered correct chinuch for people to bring their
young children forward so that they can respectfully kiss the Torah
mantle.(24) Some have the custom that adults also kiss the Torah when it
passes,(25) while others frown upon this custom and allow only touching or
pointing at the Torah and then kissing that hand.(26)

When some people carry the Torah to the bimah, they detour or bend down to
allow those who are not within reach of the Torah to kiss it or touch it.
Some poskim refer to this as an act of degradation, and those who do so
should be strongly reprimanded.(27)

When two or more Sifrei Torah are taken out of the aron, the ones that are
not currently being used are entrusted to a responsible individual to hold
until they are to be used. It is improper to allow a child to hold the
Torah,(28) and it is prohibited to leave a Torah unattended even if it is
left in a safe place.(29)

It is prohibited to turn one's back to a Torah.(30) Accordingly, those who
sit in front of the shul directly in front of the Torah must turn around
during Kerias ha-Torah. When, however, the Torah is read from a bimah(31)
[or from a table which is over forty inches high(32)], this prohibition
does
not apply.

Often, those holding a second or a third Sefer Torah (e.g., on Yom Tov)
sit
behind the Torah reader or the person being called to the Torah, who are
then turning their backs towards those Sifrei Torah. While some poskim
disapproved of this,(33) the custom to do so is widely accepted.(34)
Others
hold that this is only permitted during Kerias ha-Torah or during haftarah
that is read from a klaf. But during a haftarah that is read from a
Chumash
or during Ashrei, etc., the reader or the chazan should move to the side
so
that his back is not directly facing the Torah(35).

FOOTNOTES:

1 It is considered a segulah bedukah for an easy labor, for the husband of
a
woman in her ninth month of pregnancy to receive the honor of opening the
aron; Chida, Avodas ha-Kodesh, Moreh B'etzba 3:4.

2 Aruch ha-Shulchan 282:1, based on Mishnah Yuma 68b.

3 Sha'arei Efrayim 10:2.

4 Sha'arei Efrayim 10:2.

5 Rama O.C. 134:2.

6 Mishnah Berurah 282:1. The Chazon Ish held that the "face" of the Torah
should be towards the person who is holding it (Tefilah K'hilchasah, pg.
312), but many people hold the Torah facing away from themselves.

7 German communities do not recite Berich Shmei; Siddur Avodas Yisrael,
pg.
122. Many Sephardim recite it only on Shabbos; Ben Ish Chai, Toldos 15.

8 Several Kabbalists attach great importance to the recital of Berich
Shmei,
since the time when the Torah is removed from the aron is considered an
eis
ratzon (auspicious time) in which one's prayers are more readily answered;
see Yeshurun Torah Journal, vol. 2, pg. 579.

9 Since Aramaic tefillos may be recited only b'tzibur, it is important to
recite Berich Shmei together with the congregation; See Mishnah Berurah
101:19. See also Yesod v'Shoresh ha-Avodah 5:8 who says that an individual
should recite Berich Shmei even in middle of Ve'hu rachum (during the
week).
During Pesukei d'Zimrah, however, one should not stop to recite Berich
Shmei; Teshuvos Maharshag 1:52.

10 Darchei Chayim v'Shalom 196. This also seems to be the view of Aruch
ha-Shulchan 282:1, and is the custom in most places.

11 Mateh Efrayim 619:48; Rav Pealim 3:8; Igros Moshe O.C. 4:70-9, based on
Sha'arei Efrayim 10:1; Az Nidberu 8:48. Harav S.Z. Auerbach (Halichos
Shelomo 12:9) maintains that either way is acceptable.

12 Mishnah Berurah 134:13. Pischei She'arim to Sha'arei Efrayim 10:1
maintains that it may be said during hagbahah as well.

13 Aruch ha-Shulchan 282:1.

14 Mishnah Berurah 134:13.

15 "Stand" means that if one is sitting he must stand up and if one is
walking he must stand still (until the Torah passes by); Aruch ha-Shulchan
Y.D. 282:3.

16 See Aruch ha-Shulchan Y.D. 282:5; Shulchan ha-Tahor 149:2; B'tzeil
ha-Chochmah 5:139; Minchas Shelomo 1:33; Halichos Shelomo 12:13; Teshuvos
v'Hanhagos 2:319 and Tzedakah u'Mishpat 16, note 37.

17 Orchos Rabbeinu, vol. 2, pg. 308.

18 Mishnah Berurah 146:17, based on Y.D. 282:2. According to some
opinions,
the requirement is to stand as long as one can sense that the Torah is
being
carried, even if it is not visible to him.

19 Based on Sha'ar ha-Tziyun 146:18; Igros Moshe O.C. 5:38-4; Minchas
Shelomo 1:33.

20 Accordingly, a weak or ill person may sit; Meishiv Halachah O.C. 248.

21 Some poskim mention that it is proper to follow until it reaches the
bimah (Chayei Adam 31:42), while others write that it is sufficient to
follow along "a bit" (Sha'arei Efrayim 10:4; Halichos Shelomo 12, note
17).

22 Mishnah Berurah 149:7.

23 Aruch ha-Shulchan 149:3; 282:1.

24 Rama O.C. 149:1.

25 Sha'arei Efrayim 10:4; Kaf ha-Chayim 134:10; 149:10.

26 Pischei She'arim 10:4 quoting Kitzur Shelah; Siddur Tzelosa d'Avraham,
pg. 375; Harav Y.E. Henkin (Eidus l'Yisrael 63).

27 Teshuvos Yad Yitzchak, quoted by Beis Baruch 31:171; Teshuvos Rivam
Shneituch, quoted in Tzitz Eliezer 12:40. [Possibly, if the detour is for
the sake of a person who is unable to come to the Torah, i.e., a
handicapped
person, it would be permissible.]

28 Mishnah Berurah 147:29.

29 Igros Moshe O.C. 1:38.

30 Y.D. 282:1.

31 Rama Y.D. 242:18; Mishnah Berurah 150:14.

32 Taz Y.D. 242:13. See, however, Pischei Teshuvah Y.D. 282:2, who seems
to
imply otherwise. See also Minchas Yitzchak 5:78.

33 Mishnah Berurah 147:29.

34 Halichos Shelomo 12, note 21.

Fw: [TeaneckShulsChat] Fwd: Check out The real picture

It's an urban legend.

Jonathan Marks discusses it in this week's Jewish Week, "Tragedies Real
and
Imagined: Herzl's children and the myth of phantom e-mails".

We have enough legitimate gripes against the media, including Reuters.
(Their photographs and captions are often misleading and manipulative --
see CAMERA's "Reuters photos pictures of bias" at
.)

But we weaken our case when we spread misinformation. If you've circulated
this to others, please retract.

zvi

P.S. Here's an excerpt from Marks' article
( ):

One of the great phenomenons arising out of the confluence of politics and
the Internet has been the phantom e-mails, unattributable information from
obscure sources, that are forwarded around the world and, too often,
accepted as fact.

Among Zionists, these phantom e-mails often take the form of complaints
about the media's bias against Israel. The most recent example is the
deluge of e-mails we've received about a pair of photographs that are said
to have been "widely distributed" for the sake of Palestinian propaganda.

In the first photo, an Arab boy is seen in the far distance throwing a
rock. In the second photo, the boy is arrested, looking up in terror at
his
Israeli soldier-captors, supposedly having "wet his trousers," according
to
the caption. We're told that the "biased" media only ran the picture of
the
little boy under arrest, not the one of him throwing a rock.

How do these things get started? This campaign was the product of Politics
Now, a Hebrew-language Israeli political portal and Web magazine run by
Yossi Shturm, 39, who told The Jewish Week he's the former chair of the
student union at Tel-Aviv University, and later the National Union of
Israeli Students, before working in the press and communications division
of the Jewish Agency and striking out on his own.

Shturm says the photo campaign began on April 7, when he received an
e-mail
from an Israeli in Japan containing the picture of the arrested
Palestinian
child, with a note saying that the picture came from a Palestinian source.

No, both photos were taken by Reuter's photographers, the one of the rock
throwing by Evelyn Hockstein; the one of the arrest by Natalie Behring.
The
pictures can be seen by going to the photos search on Yahoo! news section
and looking up the photographers by name.

The photo of the arrested child inspired compassion, said a worried
Shturm.

In an e-mail interview, he said that when he saw the photo a second time
in
a Web discussion group, "I felt that the Palestinians are starting a media
campaign."

In fact, the only media campaign was Shturm's. When questioned, Shturm
could not name one newspaper that used these pictures. All he could cite
was a mention of the picture by Yediot Ahronot (April 10), but Yediot did
not use the picture itself.

Shturm posted the two pictures on Politics Now, and warned that the media
was using one picture, but not of the boy throwing rocks. The form-letter
e-mails to us said that here was "The picture [of the arrested Arab boy]
that moved hearts. ? Be amazed at the TRUTH regarding media treatment of
the Palestinian war against Israel.... Undoubtedly, this picture is very
moving, and everyone can share the pain and panic of the child, that led
to
such an embarrassing moment [of the wet trousers]. The Palestinians, who
truly understand the power of the image, spread this picture worldwide
[but] they did not show the other picture [that] was not as widely
distributed."

Although the initial Reuter's caption on April 6 says the Arab boy "wets
his trousers" when arrested, that supposition was soon edited out by
Reuter's. The boy's pants were clearly mucked up, but throwing rocks in
the
dust and mud is mucky business. But while Reuter's edited that out within
hours, in later sendings of the pictures, Shturm and his e-mail army did
not reflect the changed caption. The e-mails sent visitors to Shturm's
Politics Now site, not to Reuter's or Yahoo!, where the change could be
seen.

All in all, the episode was a storm warning about a storm that never was,
reflecting a Jewish mood that takes bias for granted, is convinced that
the
Arabs are publicity geniuses, and that our fears are the same as fact.
None
of that, in this case, was true.

washingtonpost.com: What Happened to The Powell Doctrine? What Happened to The
Powell Doctrine?
?
By Charles Krauthammer
?
Friday, April 20, 2001; Page A25
Not many secretaries of state are immortalized with an eponymous doctrine even
before they become secretary of state. But when Colin Powell was Gen. Powell, he
enunciated the rule that the key to success in any military conflict was the use
of overwhelming force.
The Powell Doctrine found its ultimate expression in the Gulf War. The idea was
not to match Iraqi power but to entirely overwhelm it in planes, tanks,
technology, manpower and will. That would make the war short and make victory
certain.
It did. Today, the Powell Doctrine seems obvious, but it was not at the time.
For decades the United States had followed a policy of proportionality:
restraint because of fear of escalation. It was under this theory that Maj.
Powell watched his men bleed and die purposelessly in Vietnam.
Powell understood the problem. If you respond proportionately, you allow the
enemy to set the limits and level of fighting. You grant him the initiative. In
Vietnam, proportionality brought us endless losses and painful retreat.
Powell learned a lesson for his generation. There would be no more
self-restraining, self-defeating proportionality. "First we're going to cut it
off," said Powell memorably of the Iraqi army. "Then we're going to kill it."
That was then. A decade later, Powell seems to have carved out an exception to
his rule.
In the past few weeks, the Palestinians have ominously escalated their six-month
guerrilla war of riots, shootings and terrorist bombings. Their new tactic is
launching mortar rounds from Palestinian territory into Israel. We're not
talking about attacks on settlers, or settlements, or soldiers, or outposts, or
crossroads. We're talking about attacks on towns within Israel proper, such as
the peaceful desert town of Sederot, attacked this week.
Israel responded to this alarming escalation not with a proportional tit for
tat, which would only regularize and institutionalize -- and legitimize -- such
cross-border Palestinian aggression. Instead Israel delivered a sharper
deterrent blow: occupying a piece of Gaza from which the attacks were launched.
In other words, Israel applied the Powell Doctrine. And what did it get? The
sharpest rebuke from an American secretary of state in years. On Tuesday, Powell
denounced the attack as "excessive and disproportionate" and demanded Israel's
retreat.
Israel docilely complied. It will regret that decision, as will the United
States.
Powell's policy is understandable but shortsighted. He wants to keep the
violence down. And every call for Arafat to stop his war has been met with
contemptuous rebuff.
In his March 29 news conference, President Bush had said that the signal he's
"sending to the Palestinians is stop the violence. . . . And I hope that
Chairman Arafat hears it loud and clear. . . . This is not the first time the
message has been delivered."
Yet since March 29, Arafat has escalated the violence with the cross-border
mortar attacks. Taking the most limited view, Powell's policy is: If Arafat will
not be restrained, restrain Israel and hope that this round won't blow up. But
it is a losing proposition. As long as Arafat controls the tempo of violence --
as he does whenever Israel is forced into a futile Vietnam-like "proportionate"
response -- he will keep the fires burning.
And those fires are the real problem. They threaten to undermine the single most
important American objective in the Middle East: prevention of a regional war.
The spark for such a war would be the intifada that Arafat started six months
ago. It is his fondest wish to bring Syria and Lebanon, Iraq and Iran, Egypt and
Jordan into his war with Israel.
He might yet succeed. Hezbollah, in support of the Palestinians, is opening a
second front, launching its own cross-border attacks from Lebanon. On Saturday,
it killed an Israeli soldier on patrol on his side of the internationally
recognized border. That was meant to provoke -- it did provoke -- Israeli
retaliation against Syrian positions in Lebanon.
The constant violence Arafat began six months ago has created an intolerable and
unstable situation. It can end in one of only two ways: Arafat calls it off, or
it explodes in the kind of Middle East war we have not seen since 1973.
Arafat's only incentive to call it off is if his war exacts from him a higher
price than he can bear. Losing some of the territory he gained from Israel in
the Oslo peace accords is a serious price.
Israel is trying to make him pay it. It is precisely the kind of deterrent
policy Powell had been preaching for years. Until Tuesday.

The real picture

The real picture
The picture
that moved hearts

This Picture was taken near the Temple Mount in Jerusalem, on Friday, April 6, 2001, by Evelyn Hockstein, a Reuters photographer.
A Palestinian child was caught by Israeli policemen, and, in his fear - he wet his pants.
Undoubtedly, this picture is very moving, and everyone can share the pain and panic of the child, that led to such an embarrassing moment.
The Palestinians, who truly understand the power of the image, spread this picture worldwide, through the media and e-mails, but - they did not show the other picture.
A few minutes before the above picture was taken, another Reuters photographer, Natalie Behring, had taken the following picture -- which was not as widely distributed (please notice the child in the center of the pic):

Well, yes, it's the same child. Only at this stage, we may assume that his pants were still dry...

Fw: Award to Conrad Black

HonestReporting Communique

"AWARD WINNER: PUBLISHER CONRAD BLACK"

* * *

Dear Friend,

Rarely does a major newspaper publisher publicly censure one
of his prized writers. But last week, media mogul Conrad
Black heavily criticized Taki Theodoracopulos, a columnist at
Black's own British Spectator.

The background to this public haranguing is as follows: On
February 24, in discussing President Clinton's pardon of
financial fugitive Mark Rich, Taki declared: "The way to
Uncle Sam's heart runs through Tel Aviv and Israeli-occupied
territory," and "America was not as yet Israel-occupied
territory." Taki used the Rich case as a pretext to condemn
Israel for attacking "rock-throwing youth with armour-
piercing missiles" and "shooting at kids."

On March 3, The Spectator's publisher, Conrad Black,
responded full force. "Taki's reflections were indefensible,"
Black wrote. "He expressed a hatred for Israel and a contempt
for the United States and its political institutions that
were irrational and an offence to civilised taste. In the
process, I am afraid he uttered a blood libel on the Jewish
people wherever they may be."

Black's lambasting continued: "In both its venomous character
and its unfathomable absurdity, this farrago of lies is
almost worthy of Goebbels or the authors of the 'Protocols of
the Elders of Zion.' The Jews, according to Taki, have
suborned the US government, direct that country's military
like a docile attack dog, and glory in the murder of innocent
or mischievous children. He presents the universal Jewish
ethos as brutish, vulgar, grasping and cunningly wicked."

Black's strong words sent ripples of fear through the ranks
of anti-Israel journalists throughout the world. Black sits
astride one of the world's largest newspaper empires -- the
Hollinger Group () -- which includes
The Spectator, Daily Telegraph of London, Chicago Sun-Times,
Montreal Gazette, Jerusalem Post, and others. His newspaper
holdings in Canada represent an estimated one-third of
Canada's entire daily circulation.

In recognition of this highly unprecedented and bold public
stand, HonestReporting is proud to confer upon Conrad Black
our "Monthly Award for Honest Reporting."

Just as it is important to criticize media bias, it is also
important to single out for praise examples of media honesty.

But there's more. Publisher Black went beyond taking Taki to
the woodshed; he protested the overall British media and
government treatment of Israel -- singling out
HonestReporting targets BBC and Guardian. Black wrote:

"[Taki's] opinions are not greatly more extreme than those of
large sections of the British media which habitually apply a
double standard when judging the Israelis and Palestinians.
Behind the spurious defence of merely seeking justice for the
Palestinians, most of the relevant sections of the BBC,
Independent, Guardian, Evening Standard and the Foreign and
Commonwealth Office are rabidly anti-Israel. I doubt that
most of the people involved would be hostile to someone
merely because that person was Jewish, though some would, but
they are almost all, wittingly or not, stoking the inferno of
anti-Semitism."

But Black didn't stop there. He also lambasted Yasser Arafat
and the Palestinian Authority, according them sole blame for
the violence:

"Israel, after an unconscionable length of time, and with the
exact borders still in dispute, has accepted the principle of
two states in the territory it once hoped to occupy itself.
The Palestinians have not accepted the right of the state of
Israel to survive. They do not accept the Israelis as an
indigenous people and still think of them as foreign colonial
occupiers like the British, the Turks and the Romans. This
and the implosion of Arafat's authority among his own people,
and not the actions of the Israelis, are the sources of the
present impasse, and every knowledgeable observer of the
Middle East knows it."

Black continues:

"The West Bank is now governed by groups of thugs, and Arafat
has been afraid to go there for several months. The
Palestinian Authority is a brutal dictatorship and one of the
most financially corrupt regimes in the world. The PLO has
not lived up to any of its significant obligations under the
Oslo Accords."

HonestReporting encourages its members to praise Conrad Black
for his bravery in going public against the anti-Israel media
establishment.
