This week¡¯s City Council meeting. Here¡¯s the agenda for this week¡¯s Council meeting. As always, you can sign up to comment via Zoom ¨C the link for signing up can be found on the agenda. We will get a third-quarter financial report for FY25 (through March 31). Then we will move on to a lengthy set of preliminary or final votes related to: the FY26 budget the FY26 property tax rate (which will, as you probably know by now, be unchanged at $0.5522 per $100 assessed value) grants for public art refurbishment and computer purchases (see #5 below) procurement of HVAC system improvements (see #6 below) and a Ward 6 traffic study (see #7 below) a resolution authorizing a grant application for the Purple Line Connector project (for a safe link between the Takoma-Langley Crossroads station and the New Hampshire Avenue bikeway) a resolution confirming the Council¡¯s choices of FY26 traffic-calming and sidewalk projects potentially, a resolution to adopt City Council Priorities for the current term (see #8 below) We will also convene as the Stormwater Management Board to vote on the budget and stormwater fee rate for FY26. During the budget process, I agreed during the budget process with the idea of increasing that rate by $5 per 500 square feet of impervious area, from $25 to $30, with an objective of addressing urgent mitigation needs more rapidly. I remain committed to exploring ways for residents to take better advantage of County-offered rebates for rain gardens, and I will advocate for a clear-eyed examination of the pros and cons of relinquishing municipal control over stormwater management. Finally, we will have a Work Session to review a draft Resolution establishing the Council Compensation Committee. 2. Community outreach for Piney Branch Elementary School (PBES) renovation. Main points: A study is underway, looking at options for renovation of PBES. Most likely, work will commence in the 2028-29 school year and require two years. Initially, consultants have said that the County has ruled out construction of a new school behind the current one or at another nearby site. Therefore, most likely students would be bused to another holding campus for two years. Renovation options include the possibility that the community pool could be discontinued. Residents are urged to participate in one or more of the three remaining community meetings (5/15. 5/29. 6/4). In detail: We found out less than two weeks ago that Montgomery County Public Schools (MCPS) has contracted with a consultant to study options for the renovation of Piney Branch Elementary School (PBES). These renovations would be focused primarily on updating the building and campus to increase its functionality, including such aspects as the provision of natural light to classrooms, the separation of bus traffic from drop-off traffic, improved access to the park and play area behind the school, and better flow between levels, including possible removal of the split-level floor configuration. Car shooting 5
Hello all, I'd like to make everyone aware of a shooting that took place Wednesday evening in the block of DC before the traffic light at Eastern and Kansas. My son was driving home from work late (10) and someone shot out the window of a row house at his car, randomly, breaking the vent glass in the rear seat driver's side window. Three feet and my son would have been shot, certainly wounded, possibly killed depending on where the shot landed. He called the police, gave his location as Takoma Park, several cruisers from Takoma Park showed up in minutes, but had no jurisdiction. The DC police arrived-one patrol car-over an hour later. The DC police called it "misdemeanor property damage" and declined to investigate further, despite my son knowing which row of houses the shot came from. He's out $700 in repairs (the car is 20 years old, and while in great shape, he declined to get comprehensive, and anyway it would have been a $500 deductible). Does anyone have any idea how to escalate this? It was most likely someone young. Even if no one has any ideas, please be aware when driving in that block. This could be you. The idea for a Takoma Park House and Garden Tour that year was the brainchild of Takoma resident Ellen Marsh of Maple Avenue. Her goal was to celebrate the architectural wealth and landscape beauty of our community so that others would begin to cherish and protect it. And Takoma Park needed protecting.When Ellen and her young family moved to Takoma Park in 1963, Takoma was suffering from years of absentee landlords who had allowed properties to deteriorate and neighborhoods to become shabby. Now new families were moving in and renovating the aging old houses. Ths following year, however, the State of Maryland mandated a ten-lane North Central Freeway, which would have cut through the heart of town, taking all homes in its path, displacing 300 families. Residents led by Sammie Abbott and the city government pushed back. North Central Freeway's proposed route from city newsletter, December 1964 .The courts eventually ruled that highway financing be shifted to allow construction of the Metro mass transit system. Not surprisingly, developers were now targeting the aging houses in the blocks adjacent to the proposed Metro station. Meanwhile, in North Takoma, Montgomery College¡¯s planned expansion threatened more old homes. This prompted Ellen Marsh to launch her idea for a tour. Neighbors were recruited and homeowners wooed to open their houses, reaching across the city in an effort to be as inclusive as practical. This first tour was an overwhelming success. It included 38 houses from North Takoma to New Hampshire Avenue. A single-page street map with house addresses was handed out for $1.50. By the 1974 tour, an official brochure featured town founder B.F. Gilbert's house, drawn by Sammie and Susan Abbott. Ellen and Allan Marsh wrote architectural and historic backgrounds on all 28 houses. The early house and garden tours played a part in helping residents to see the city in a new light. The city council began to support clean-up programs and approved the Project Turnaround designed to buy, restore and resell dilapidated houses in the 7100 block of Cedar Avenue. Thanks to the work of the Takoma Park Preservation Association, the city was listed in the National Register of Historic Places. And in 1983, Takoma Park became the largest historic district in Montgomery County, with resulting protections. The House and Garden Tour laid the groundwork for these designations. Historic Takoma, founded in 1979, officially took over coordinating the House and Garden Tour in 2002. Soon after, Historic Takoma purchased and renovated the storefront at 7328 Carroll as its headquarters, thanks to generous grants from the State of Maryland and Montgomery County. Since its opening in 2012, the building has served as public space for our programs and exhibits. It also houses Historic Takoma¡¯s growing archives collection covering 100+ years of Takoma Park history. Proceeds from the House and Garden Tour are critical to maintaining this beautiful space. Gas range repairperson
Our (every expensive) gas range has sprung a gas leak in one of its burners. Does anyone know of a good repair person for it. We called Washington Gas because the odor of gas in our house was so strong (and thanks to neighbor Becky for verifying the smell). Turned out to be a faulty burner. Ward 3 update: Community meeting about Piney Branch ES, recent settlement, budget outcome, tonight's CC meeting
Hello Ward 3 neighbors, This update will focus on (A) community meetings on Piney Branch Elementary School renovation options (which could affect the Piney Branch Pool), (B) the City¡¯s recent settlement of a sexual harassment/retaliation case, (C) the outcomes of last week¡¯s final budget reconciliation session, and (D) the agenda for tonight¡¯s City Council meeting. - Click here for a searchable archive of previous updates. - (A) Piney Branch Elementary School and Pool ¨C your input needed at community meetings. Montgomery County Public Schools (MCPS) is commencing a Feasibility Study examining possible options for renovating, expanding, and/or rebuilding Piney Branch Elementary School. Some of the options under consideration appear to involve removal of the Piney Branch Pool, which I strongly oppose. Please consider joining MCPS for one or more of the 4 community meetings below focused on the Piney Branch Elementary Feasibility Study. All of the meetings will be at the Piney Branch Elementary School Cafeteria. It is fine to join for one and not the others. Tomorrow night ¨C Thursday, May 1: 7-8pm Thursday, May 15: 7-8pm Thursday, May 29: 7-8pm Wednesday, June 4: 7-8pm The City is not the organizer of these events, but it¡¯s important for as many residents as possible to participate ¨C including people who wish to express their views about the swimming pool. All options under consideration would use the existing site, small as it is, for any renovation of the school. Creative options for the site could include making a stronger connection to, and use of, the adjacent Montgomery Parks property (Ed Wilhelm Field). At the introductory presentation about this process last week, I asked whether an additional story could be added in conjunction with a new egress bridge or route out the back to the playground area. In my mind, this might be an approach that could add capacity without leading to the loss of the swimming pool. The response was that this could be a possibility. I plan to attend the community meeting on Thursday to propose this idea. The County webpage for the project can be found here. (B) City settlement of harassment and retaliation case. As you may know, City Council members were informed less than two weeks ago that the City had agreed to a settlement in a case alleging sexual harassment of a Police Department employee and subsequent retaliation on the part of other department members. The settlement was paid for via the City¡¯s insurance policy. I did not have any prior knowledge of the details of this case. Last Wednesday, the City Council voted to go into closed session to discuss this matter. We spoke with the City¡¯s two outside attorneys (one for general matters, one for matters involving unions) to discuss what facts and documents can be shared with the public without violating legal requirements for confidentiality and privacy under the MD Public Information Act (MPIA) and the Police Accountability Act (PAA). There are two separate threads involved: a police disciplinary proceeding, and a subsequent civil suit. Different procedures apply. I¡¯m advocating with Council colleagues to get many questions answered. I¡¯ve been awaiting clear guidance about what can be disclosed in this matter, which involves personnel, one a sworn police officer. Like you, I¡¯ve seen the redacted complaint that the plaintiff¡¯s attorneys made public, but I have not seen the settlement or any other details of the case. I¡¯m confident that there will be more Council oversight. Things are moving at deliberate speed. Thank you for your vigilance and expressed outrage (which I share) about this case. In addition to many individual comments, the Council received a petition signed by over 165 residents, demanding answers. I am in solidarity with the concerns expressed in that letter. The safety of our residents and employees, the integrity of our City policies and practices, and the need for maximum transparency are all major concerns for me, and I will not set these issues aside. To answer a few of your questions that I believe I can answer: I

Sexual Harassment Case 6
Just so no one here burns down my house or banishes me from the city, I read the complaint and that sounds horrible. 100%. I realize the sexual harassment is common. Any report of such needs to be taken very seriously. Some thoughts and questions below. Questions mostly about process and procedures, both in general, and how they were applied in this case. None of which should be confidential information. A few questions for Roger or anyone else that can answer: 1) Are the officers and civilian employees in the same union or different unions? 2) Roger, I know you can¡¯t share confidential details, but can you tell us if there was an independent investigation? [And what are the city¡¯s policies and procedures in such cases.] 3) Are the police (and any other city staff for that matter) required to report to the city manager (and, therefore, ultimately to the city council) when harassment and/or retaliation is reported? (so that it can be independently investigated?) The complaint states that the officer was suspended (the implication is due to this conduct). If that happened, it seems to me that an independent, outside investigation should have been initiated then and there. (Similarly once retaliation was alleged.) 4) What does the city pay annually for its insurance? This would provide us with a sense of scale. I presume this is in the budget documents somewhere? I noticed that there are quite a few timeline details in this complaint that could be collaborated by someone with access to city records (e.g. a council member). I¡¯m not talking about personal details, but I¡¯m talking about when investigations were initiated, when they were closed, when people were disciplined, suspended, brought back on (which should be part of the record), etc. If those are collaborated, it would indicate to me that internal procedures with the city, and the police department in particular, may be sorely lacking. I recognize that there may be additional relevant details not mentioned in the plaintiff¡¯s complaint, which is why I¡¯d like to know: 5) if someone independent of the city manager, the police, or the plaintiff has done that bit of due diligence. (This is separate from my question above if an independent investigation of the harassment and retaliation was conducted.) Just thinking through some numbers. We should all recognize that a settlement doesn¡¯t necessarily mean culpability. (I know I¡¯m probably not ¡°allowed¡± to say that in liberal TkPk, but its true nonetheless¡­) $1M is not small change (but it also might not be considered large in this context either from the insurance point of view). The insurance company and city lawyers obviously thought that it was worth settling rather than going to court. Just doing the math, if they estimated that there was a 10% chance of a trail resulting in a $10M settlement, then paying out $1M makes financial sense, independent of the merits of the case. Sad thing is, we may never know the whole story due to legal constraints. But I hope that the council, who I hope does know sufficient details (although I suspect that its possible they can¡¯t be told all the details) will take appropriate action. If there wasn¡¯t an independent investigation, there certainly should have been. (And if there wasn¡¯t, that seems very problematic in my view. But before running with that thought, I hope we can all get answers to the questions I posed above first.). To state the obvious, this situation undermines the public¡¯s trust in our police department. I hope that the official response is not to ¡°lawyer up¡± and not allow any information whatsoever out (which, unfortunately seems to be the default.). We need to understand if there is something seriously amiss here in TkPk.
